Terms & Conditions

Fair, transparent terms for you and for us. Last updated: September 2026.

We offer two different products with different terms. Select the one that applies to your booking:

1. About These Terms & Our Role

These terms govern weekly driving lessons (up to 4 hours per week) arranged through PASS-UK Driving School, operated by National Intensive Ltd ("we", "us", "PASS-UK"). By booking and paying for lessons you agree to these terms.

PASS-UK is solely a booking agent and charges a fee to facilitate and assist in arranging lessons with your driving instructor. All driving instructors in our network are self-employed Approved Driving Instructors (ADIs) — they are not employees or agents of PASS-UK. If there are any issues with the driving instructor such as lateness, cancelled lessons, or a bad experience, you need to raise that complaint directly with the instructor. We are fair in these circumstances and can offer a new instructor allocation free of charge, if another instructor is available.

Our sole responsibility is to provide a service where learner drivers can easily book lessons with a driving instructor. We speed up the process and save you messaging, calling or emailing instructors directly. The contract for driving lessons is formed directly between you (the pupil) and the driving instructor. Any disputes or claims about the lessons must be addressed with the instructor. PASS-UK cannot be held liable for any compensation claims from the pupil and operates solely as a booking agent.

For your security, all money you pay to PASS-UK is held by the school and only dispersed to your instructor after lessons have been delivered. This staged payment model protects you — your funds are never at risk and your instructor is paid reliably for work completed.

A small administration fee is included within the booking price to cover PASS-UK's administration and running costs (instructor matching, scheduling, payment processing, and customer support). This fee forms part of the total displayed at checkout and is not charged separately.

2. Booking & Payment

  • Lesson prices are quoted per hour and vary by postcode area and transmission type.
  • Block-booking discounts apply to packages of 10 hours or more, as shown at checkout.
  • Payment is taken securely online via Stripe. Your funds are held by PASS-UK and dispersed to your sub-contracted instructor in stages only after lessons have been delivered.
  • A small administration fee is included within the total price to cover PASS-UK's booking, matching and running costs.
  • A booking is only confirmed once payment has been received in full.

3. Refund & Cancellation Policy

We require up to 14 days from the point of booking to arrange a driving instructor for you. We offer a refund guarantee: if a driving instructor hasn't been allocated within 14 days of booking, a full refund can be requested. A refund cannot be processed within the 14 days of booking as we accrue costs to take your booking on and we ask for a 14-day period to get your lessons arranged.

If we have allocated a driving instructor within 14 days and you are unhappy with that instructor, we can reallocate a new instructor free of charge but no refund is eligible. If the allocated instructor hasn't contacted you or you can't agree on a lesson schedule, we will allocate a new instructor free of charge. Refunds are only eligible if a driving instructor can't be allocated.

Once a driving instructor has been allocated to your booking, the service has been provided and no refunds are offered on the deposit. If you are seeking a refund or partial refund for lesson tuition paid to the instructor, this can only be requested from the instructor directly.

To exercise your right to cancel, email us with your name and booking reference. Refunds are processed to the original payment method within 5–10 working days.

4. Lesson Cancellation Policy

When taking weekly driving lessons, you need to give the instructor a minimum of 48 hours' notice, otherwise they are entitled to charge for any lessons cancelled within this period.

  • More than 48 hours' notice: No charge. The lesson can be rescheduled at no cost.
  • Less than 48 hours' notice: The lesson is chargeable and will be deducted from your remaining paid hours, as the instructor's time has been reserved and cannot be reallocated at short notice.
  • Same-day cancellation or non-attendance: Treated as a delivered lesson and charged in full.

If you need to cancel or reschedule, contact your instructor or the school as early as possible. We will always try to accommodate genuine emergencies — please speak to us.

5. Booking Time Off Work & Out-of-Pocket Expenses

Please note that all bookings are only provisionally scheduled once payment is made and you must not book time off work, book any hotels, or incur any out-of-pocket expenseuntil an instructor has made contact and arranged your full lesson schedule. PASS-UK cannot be held responsible for any losses arising from a change in schedule, cancellation due to weather, or an instructor issue preventing lessons going ahead.

6. Your Lessons

  • Lessons are typically 1, 1.5 or 2 hours in duration, as agreed with your instructor.
  • Your instructor will tailor lessons to your experience level and learning pace.
  • You must hold a valid UK provisional driving licence and bring it to every lesson.
  • You must be fit to drive — not under the influence of alcohol or drugs, and not excessively tired.
  • If your instructor judges you unfit to drive at the start of a lesson, the lesson may be cancelled and charged as a short-notice cancellation.

7. Practical Driving Test

  • Booking your practical driving test is your responsibility, though we can offer guidance.
  • From 12th May 2026, only the pupil can book and manage their own driving test due to a change in the law. You may use our community test swapping portal if you have paid access to any cancellation finding services.
  • We do not guarantee a test pass — no driving school can. Your success depends on your individual ability, practice and test-day performance.
  • Your instructor will advise when you are test-ready. Taking your test before your instructor recommends it is at your own risk.
  • Use of your instructor's car for the practical test may be arranged subject to availability and an additional fee.

8. Theory Test & Additional Services

If you have added a theory test booking service (£35), once a theory test has been booked the fee is non-refundable. If you cancel the theory test before it is booked, a refund of the standard DVSA theory test cost may be offered. Theory training and revision materials are non-refundable under any circumstances as these are booked instantly when you make your booking online.

The Driving Test Swap (Swappy VIP) service is £60 and includes lifetime access to the portal and unlimited swaps. This optional charge is non-refundable if you have created an account and had access to the service for 14 days.

9. Code of Conduct

We ask you to commit to:

  • Treating your instructor with courtesy and respect.
  • Being punctual and giving as much notice as possible for cancellations.
  • Being honest about your experience, confidence and any concerns.

10. Complaints

If you are unhappy with any aspect of your lessons or service, please raise it with us as early as possible. We will acknowledge your complaint within 3 working days and work to resolve it promptly and fairly.

If you wish to make a serious complaint about the driving instructor, you need to contact the DVSA immediately (Driver and Vehicle Standards Agency), who governs all driving instructors, and make us aware of the complaint. Visitgov.uk/complain-about-a-driving-instructor for more information. If we cannot resolve your complaint internally, you may also refer it to Citizens Advice consumer service.

11. Data & Privacy

We store your personal details (name, contact information, and lesson records) securely and use them solely to deliver your lessons and administer your booking. We do not sell your data to third parties. You may request access to or deletion of your data at any time.

12. VAT & Tax Position

Driving tuition is a standard-rated supply for VAT purposes. It does not qualify for the education or private tuition exemptions — the Court of Justice of the European Union ruled in A & G Fahrschul-Akademie GmbH (Case C-449/17) that driving tuition is not a subject ordinarily taught in schools or universities, and HMRC's VAT Notice 701/30 confirms this position.

PASS-UK operates as a booking agent for a network of self-employed ADIs. When you book, you pay PASS-UK. The greater part of the fee is dispersed to your instructorfor the lessons they deliver; PASS-UK retains a commission for its booking, matching, and administration service.

Your instructor's share is the instructor's own supply. Whether VAT applies to it depends on whether that individual instructor is VAT-registered — many self-employed instructors operate below the VAT registration threshold and are not registered.

PASS-UK's commission is its own taxable supply and is standard-rated at 20% where National Intensive Ltd is VAT-registered. VAT is included within the total price displayed at checkout. This position is kept under regular review and may change if HMRC guidance or the law changes — any change would be reflected in the price displayed at checkout before you pay.

13. Changes to These Terms

We may update these terms from time to time. Any changes will be posted on this page with an updated revision date. Terms in force at the time of your booking apply to your contract.
